These Terms govern purchases and use of the PetMemoir store you are visiting. They are written for both PetMemoir Portrait and PetMemoir Blanket, with separate rules where a custom physical product and digital artwork differ.

1. PetMemoir and these Terms
“PetMemoir,” “we,” “us,” and “our” mean the operator identified for this PetMemoir store in checkout and order records. By using the store or placing an order, you agree to these Terms and the policies linked from them. If mandatory law gives you rights that conflict with these Terms, those rights continue to apply.
2. Eligibility and accounts
You must have legal capacity to make the purchase or be acting with a parent or guardian’s authorization. Keep account and order-access information secure and provide current, accurate contact, delivery, and payment information. Shopify Customer Accounts may be used to view orders and native tracking information.
3. Products and product information
PetMemoir offers customized products made from customer-provided pet photographs. Product pages identify whether an item is:
- digital artwork only;
- a custom physical Portrait product, with any stated digital inclusion; or
- a custom physical Blanket bundle that includes digital artwork.
Images and previews are presented as accurately as reasonably possible, but screens, print materials, weaving or fabric, cropping, and manufacturing can produce differences in color, texture, scale, and fine detail. Dimensions and prices are controlled by the current product page and checkout.
4. Your photos and instructions
You keep ownership of your original photo and other content. You confirm that you own the content or have all permissions needed for PetMemoir to use it for your order, including permission from the photographer and any identifiable person. Do not upload unlawful, infringing, deceptive, abusive, or privacy-invasive content.
You grant PetMemoir and its service providers a limited, worldwide permission to host, copy, crop, adapt, transform, review, transmit, and otherwise process the content only as reasonably needed to create the requested artwork, produce and deliver purchased products, store necessary order assets, provide downloads and support, prevent misuse, and comply with law. This permission lasts for as long as those purposes reasonably require. It does not transfer ownership of your original photo to PetMemoir.
PetMemoir will not use an order photo or artwork in public marketing merely because you purchased. Any portfolio, testimonial, or promotional permission should be obtained separately.
5. Automated and AI-assisted artwork
Artwork may be created with automated or AI-assisted tools as part of PetMemoir’s workflow. The result is an artistic interpretation, not a forensic or pixel-perfect reproduction. Natural variation can occur in pose, crop, line, texture, color, background, expression, and small features. A variation is not by itself a defect.
PetMemoir will review a claim where a file or product is materially inconsistent with the selected product, approved preview, or accepted instructions because of a PetMemoir production error. Subjective preference, or a detail that could not reasonably be derived from the supplied photo, does not automatically qualify for a free regeneration, reprint, or refund.
6. Previews and approval
If a product offers a preview or approval step, check spelling, pet identity, crop, markings, selected style, background, and requested details carefully. Approval authorizes PetMemoir to proceed. Changes requested after approval may be unavailable or may require a new order or additional charge. If no approval step is offered, PetMemoir will produce the order using the submitted content and selections.
7. Orders, pricing, and payment
An order is an offer to purchase. PetMemoir may accept, reject, or cancel an order for reasons such as unavailable service, invalid customization, suspected fraud, pricing error, rights concerns, or inability to fulfill. If PetMemoir cancels an order it has charged and does not provide the product, it will return the applicable amount.
Prices, discounts, currency, shipping charges, taxes, duties, and available payment methods are shown at the product page or checkout. Shopify and enabled payment providers process payment. You authorize the charge shown when you submit the order.
8. Changes and cancellations
Contact PetMemoir immediately if you need to change or cancel an order. A request is not guaranteed. Custom work can begin soon after purchase; digital release and physical production are separate stages. The Cancellation Policy explains how each component is assessed.
9. Physical fulfillment and delivery
Physical Portrait and Blanket products are made to order. Processing and delivery dates are estimates, not guarantees, unless the store expressly states otherwise. You are responsible for an accurate deliverable address and for responding to carrier or customs requests. Risk, title, and mandatory delivery rights are determined by applicable law. 10. Digital delivery
A digital-only purchase has no physical shipment. A Blanket bundle includes the downloadable FinalArtwork, delivered separately from the Blanket. Access becomes available after artwork is completed and released through the method identified in the order flow or communications. Save a backup; download access is not permanent storage. 11. Returns, refunds, and quality claims
Because custom products are made for one customer and cannot normally be resold, change-of-mind returns are generally unavailable after custom work begins. Digital artwork is also generally final after delivery or access begins. Different rules apply to a wrong item, defect, delivery damage, inaccessible or corrupt file, or material PetMemoir error. See the Refund Policy and Quality & Replacement Policy. Nothing in those policies excludes rights that cannot legally be excluded.
12. Delivered artwork and PetMemoir intellectual property
Your original photo remains yours. Unless the product listing expressly grants broader rights, purchase of delivered artwork grants you a non-exclusive, non-transferable license for personal, non-commercial use, including personal display and personal gifts. It does not authorize resale, merchandise production, sublicensing, trademark use, or representing the artwork as created by another business.
PetMemoir and its licensors retain rights in the store, brand, software, workflows, layouts, templates, product mockups, and materials not supplied by you. These Terms do not give PetMemoir ownership of your original photo.
13. Acceptable use
You may not misuse the store; interfere with security or operation; scrape or reverse engineer protected systems except where law permits; submit malicious code; impersonate another person; commit fraud; violate another person’s intellectual property or privacy; or use the service for unlawful, harmful, or abusive activity. PetMemoir may refuse content or suspend access reasonably connected to these risks.
14. Third-party services
The store relies on Shopify and other providers for payment, creative processing, production, delivery, support, and related functions. Third-party links and services can have their own terms. PetMemoir is responsible for its own obligations but does not control every independent third-party service.
15. Service changes and termination
PetMemoir may update, suspend, or discontinue store features and may restrict access for a material breach, fraud, security risk, or legal requirement. Changes will not remove remedies already required for an accepted order. Sections that by their nature should continue—such as payment obligations, content permissions needed to complete an order, intellectual property, dispute terms, and liability limits—survive termination.
16. Disclaimers
Except for express product commitments and rights that cannot be excluded, the store and creative tools are provided on an “as available” basis. PetMemoir does not promise uninterrupted access, exact artistic replication, or that every customer-provided photo can produce a requested result. This clause does not disclaim responsibility for fraud, willful misconduct, gross negligence, personal injury caused by negligence where such liability cannot be excluded, or mandatory consumer guarantees.
17. Limitation of liability
To the extent permitted by law, PetMemoir is not liable for indirect, incidental, special, or consequential loss that was not reasonably foreseeable when the order was made. For a claim connected to an order, PetMemoir’s aggregate liability will not exceed the amount paid for the affected order. These limits do not apply where law prohibits them or to liabilities that cannot lawfully be limited.
18. Responsibility for unauthorized content
You are responsible for claims caused by content you knowingly submit without required rights or by your deliberate material breach of these Terms. Where law permits, you agree to reimburse reasonable, direct losses and defense costs resulting from such a claim. PetMemoir will provide notice and allow reasonable participation in the defense. This does not create liability for matters caused by PetMemoir.
19. Governing rules and disputes
To the extent permitted by applicable law, these Terms are governed by the laws applicable to PetMemoir’s principal place of business, without limiting any mandatory consumer rights that apply to you.
20. Changes to these Terms
PetMemoir may update these Terms for future use of the store. The version in effect when an order is accepted generally governs that order unless law requires otherwise. Material changes will be communicated where required.
